India Now Logs What Its Missions Abroad Do About a Trade Complaint. How an Overseas Fabric Buyer Uses That Route

On 3 November 2026 India's Directorate General of Foreign Trade amended its procedures so that Indian missions abroad must record the action they take on a quality complaint or trade dispute, and its status, on the DGFT portal, where the complainant can see it. The change is small. The route it sits on is not well known: an overseas buyer can file a complaint about an Indian exporter with the Indian government, online, at no stage needing a lawyer. What the route is, when it is worth using, and what it cannot do.

What changed on 3 November

DGFT Public Notice No. 38/2026-27, dated 3 November 2026, rewrites paragraph 8.04(iii) of the Handbook of Procedures 2023. The old text said only that Indian missions would take up the issue with the authorities concerned and update the status online. The new text says the mission takes up the complaint for redressal whether the complainant filed it directly or it was referred by the Department of Commerce's Foreign Trade divisions, and that the mission and the division must keep updating the action taken and the status on the DGFT portal until the matter is resolved or closed. All of those updates must be visible to the complainant through the portal.

In plain terms: once a complaint reaches an Indian embassy or consulate, what it did about it is now on the record and visible to the person who complained, rather than sitting in correspondence. It does not add new powers or a new deadline.

The route underneath it

Chapter 8 of India's Foreign Trade Policy 2023 sets up a mechanism for quality complaints and trade disputes between an Indian party and a foreign one. The first type of complaint it lists is a complaint from a foreign buyer about the quality of goods supplied by an exporter from India. It also covers non-supply or part supply after an order is confirmed, goods other than those agreed, and missed delivery schedules.

A complaint is filed online by an Indian or foreign entity on the DGFT website, under Services, then Quality Complaints & Trade Disputes. It goes to the DGFT regional office with jurisdiction over the Indian party and to the Indian mission concerned, and the complainant receives a unique reference number by email. Supporting documents can be uploaded with the complaint or later.

Each of 20 DGFT regional offices has a Committee on Quality Complaints and Trade Disputes, chaired by the head of office, with members drawn from bodies such as the Bureau of Indian Standards, the Export Inspection Agency, export promotion councils and the state industries department. The policy asks it to resolve complaints preferably within three months, and it can ask the Export Inspection Agency or another technical authority to assess whether the goods failed the standard. For a mill in Rajasthan the committee is the one at DGFT's Jaipur office, the only one listed for the state.

What it can and cannot do

  • It is conciliatory. The first aim is an amicable settlement between the two parties, and the policy says plainly that either side stays free to take legal action instead or as well.
  • It has teeth against the Indian side. If a complaint is not settled, DGFT can act under the Foreign Trade (Development and Regulation) Act, 1992, which allows it to suspend or cancel an exporter's Importer Exporter Code and refuse or cancel export benefits. An Indian exporter has a real reason to answer a complaint filed this way.
  • It is not a court and does not award damages. It will not set the value of a claim for you.
  • It does not cover a dispute between two foreign parties, for example a buyer and a garment maker in another country who used Indian cloth.

When a fabric buyer should use it

Almost never as the first step. A quality problem on a fabric delivery is settled fastest between buyer and mill, with roll numbers, measurements, photographs and the agreed tolerance side by side, as set out in our guide to raising a claim when bulk fabric arrives wrong. A claim made that way is also the evidence the committee would ask for.

The DGFT route is for the case where that has failed: the supplier has stopped answering, refuses to look at a claim that is clearly outside the agreed specification, or took an advance and did not ship. For a small or first-time buyer who cannot fund a dispute in Indian courts, a free government process that can reach the exporter's export registration is a useful lever to know about before placing an order, not only after.

We are an Indian exporter, so this route applies to us too. We would rather a buyer never needed it, which is why we put shade, GSM, width and defect tolerances in writing before production. To see how we set those terms on an order, Request Catalog.

FAQ

Frequently asked questions

Can a foreign buyer complain to the Indian government about an Indian fabric supplier?
Yes. Under Chapter 8 of India's Foreign Trade Policy 2023, a foreign buyer can file a quality complaint or trade dispute against an Indian exporter online on the DGFT website. It goes to the DGFT regional office covering the exporter and to the Indian mission concerned.
What did DGFT Public Notice 38/2026-27 change?
From 3 November 2026, Indian missions abroad and the Department of Commerce's Foreign Trade divisions must keep updating the action taken and the status of each complaint on the DGFT portal until it is resolved or closed, and the complainant can see those updates.
Does a DGFT complaint replace legal action?
No. The mechanism is conciliatory and the policy says either party remains free to take legal action. Its weight comes from DGFT's power to act against an Indian exporter's Importer Exporter Code and export benefits if a complaint is not settled.
How long does a DGFT quality complaint take?
The Foreign Trade Policy asks the regional committee to resolve complaints preferably within three months of receiving them. That is a target, not a guarantee.
